In a 2007 obscenity case involving actress Shilpa Shetty and Richard Gere kissing each other at a public function, the Session Court maintained the actor’s discharge. The Court noted that a woman who is the victim of street groping cannot be held accountable for taking part in the crime.
According to Additional Sessions Judge SC Jadhav, “A woman being touched on the street, in a public place, or while traveling by public transportation cannot be considered an accuser or a participant to the extent of mental culpability, nor can she be held accountable for an illegal omission that would subject her to prosecution.”
Shilpa Shetty was released from the case by a Mumbai Magistrate’s court in January 2022. The Court noted that Shetty was not to be held accountable for Gere’s actions since she was the victim of them.

The criminal revision application was filed at the Session Court by the complainant over the court’s decision to grant Shetty’s release. Shetty has said that the complainant in the case has harassed her and subjected her to hostile procedures. In the harassment case, Shetty demanded that the plaintiff pay high expenses.
The Shetty lawsuit dates back to 2007, which is 15 years ago. On April 15, 2007, the incident took place during an AIDS awareness gathering in a neighborhood of Delhi. Hollywood actor Richard Gere and actress Shilpa Shetty were present at the occasion.
Gere touched Shetty inappropriately and kissed her cheeks to demonstrate that kissing is a harmless behavior and does not spread HIV on occasion.
An obscenity charge was filed against Shetty and Gere as a result of the event.
Both were charged with violating the Indecent Representation of Women (Prohibition) Act of 1986’s Sections 4 and 6, as well as IPC Sections 292, 293, and 120-B, as well as Section 67 of the Information Technology Act of 2000.
Shetty asked for the revision application to be quashed in a criminal case. The case was lodged in Alwar, Rajasthan, but on Shetty’s request, it was moved to Mumbai.
